K Certıfıcate

K CERTIFICATE UNIT

Standards for Road transport activities were determined with Road Transport Code numbered 4925, published in Official Gazette dated 08.01.2018 and numbered 30295 and Road Transport Regulation.

According to provisions of the aforementioned Code and Regulation, K Certificates of Authority are authority certificates which natural and legal persons doing load and good transportation activities with road.

K Certificate of Authority Types

K 1 Certificate of Authority: For those who will carry goods for commercial purposes

For K 1 certificates of authority on the behalf of natural persons, the combined weights of towed vehicles and maximum loaded weights of trucks and vans are not less than 25 tons.

For K 1 certificates of authority on the behalf of legal persons, the combined weights of towed vehicles and maximum loaded weights of trucks and vans are not less than 50 tons.

K 1* Certificate of Authority: For those who will carry goods for commercial purposes with vehicles with a loaded weight less than 3.5 tons (vans etc.)

K 2 Certificate of Authority: For those who will do private transportation,

K 2* Certificate of Authority: Those who will do private transportation with vehicles with a weight less than 3.5 tons (such as vans)

K 3 Certificate of Authority: For those who will carry moving goods for commercial purposes

Those applying for K3 authorization certificate must have at least 2 self-owned unit vehicles commercially registered for carrying good and the combined weights of self-driving tow trucks and the maximum loaded weights of self-driving trucks and self-catering trucks are not less than 35 tons

Minimum Capacity Loss and Related Issues

Certificates of authority are cancelled on the condition that dates of;

a) Their registered vehicles in documents attached to the authorization certificate are out of function due to accident, burnt, scrapped and similar force majeure,

b) sold

c) cancelled with their own desire

ç) not concerned as minimum capacity because of their age

d) cancellation ex officio are taken into consideration. Besides, in the event that they loss minimum capacity limit estimated in this article and the total period for which the minimum capacity is lost is more than 630 calendar days during the validity period of the authorization certificate specified in article 17.

Notification of the Changes

(20) Among for those having certificate of authority according to the regulation;

a) Natural persons having K1 or K3  certificate of authority and natural persons or legal persons having B3, C1, D3 or K2 certificate of authority are obliged to report changes related the title, address and the persons stated in Article C of 1st Paragraph of 13th Article in their firms or capital decrease in a way that lead to lossing capital condition determined in Article 14 with the changes in agency contracts.

b) changes related Of the self-owned vehicles / vehicles registered in the vehicle certificate attached to the authorization certificate; changes in license plate information, color, chassis number or vehicle type due to accident, burns, scrapping or similar force majeure

to the Ministry in 90 days since date of the changer. 5 warnings are given to holders of certificate of authority who do not obey this paragraph.

Duration of Certificate of Authority

Duration of certificate of authority is 5 years according to Road Transport Regulation.

Renewal of Certificates of Authority

Authorization Certificates Renewal Procedures are carried out in accordance with the provisions of Article 18 of the Road Transport Regulation. ARTICLE 19- (1) Authority certificate holders can apply to the Ministry in writing from ninety days before the expiration date of the authorization certificate to renew the authorization documents. The authorization certificate is renewed based on the date on which the renewal fee is paid. The renewal fee must be paid before the expiry date of the authorization certificate and as the valid renewal fee on the date of payment. (2) In the event that the authorization certificate is submitted to the Ministry in writing within 540 calendar days after the validity period of the authorization certificate expires for renewal of the authorization documents; The certificate of authorization is renewed based on the date on which the renewal fee is paid. The renewal fee must be paid within the 540 dayS period and as the valid renewal fee at the date of payment. (3)  After the validity period of the authorization certificate expires, the right to renew the authorization certificate is lost if the application is not fulfilled within the periods specified in the first and second paragraphs, or if the conditions of renewal of the authorization are not fulfilled. 

(4)  The authorization certificate shall not be renewed without removing all the warnings on the authorization certificate and providing the conditions stipulated in this Regulation for the authorization certificate to be renewed.

(5)  The periods specified in Article 14 for renewed authorization documents start again, regardless of the period used before the renewal.

(6)  According to this article, in order to renew the certificate of authorization; It is essential that the authorization certificate is not stopped or canceled under this Regulation.

(7) The period in the second paragraph is only the right to renew the certificate of authorization, and this period does not entitle those in this situation to act. Those who act contrary to this paragraph shall be subject to administrative fines in the amount specified in the paragraph (a) of the first paragraph of Article 26 of the Law.
